This matter is before the Court upon the defendant's motion to dismiss for the failure of the plaintiff to state a claim upon which relief can be granted. The questions raised by this motion were also raised in a "REQUEST FOR RULING ON ISSUE OF LAW" filed by the plaintiffs on August 21, 1974.
