On September 24, 1971, plaintiff, while employed as a common laborer for Hibbard-Mahoney Construction Company, received accidental injuries to his right arm. Plaintiff instituted this action against his employer and its insurer, Great American Insurance Company, for workmen's compensation benefits for being totally and permanently disabled, plus penalties and attorney's fees, less benefits previously paid.
