SUGG, Justice:

This is an appeal from the Circuit Court of Lamar County where appellant, Howard Earl Polk, was convicted of manslaughter and was sentenced to serve fifteen years in the penitentiary.

The decedent, Hershel Busha, was fatally shot while driving in an automobile with his brother Oliver, his cousin Daniel Busha, and Polk. Appellant and decedent spent most of the afternoon before the homicide together...
