SINGLETON, District Judge.

On October 16, 1971, the plaintiff Barbara Seal Nagle was performing her "Dive for Life" act in Milwaukee, Wisconsin, when the rubber mattress or "sponge" upon which she was to land after a dead fall of 35 feet failed to remain inflated.
