Plaintiff, Irvin L. Magri, Jr., was dismissed from his job as a sergeant with the New Orleans Police Department on July 18, 1974. As the letter of dismissal from the Superintendent of Police, Clarence B. Giarrusso, makes clear, this action was taken because of Magri's persistent public criticism of the superintendent, in violation of the regulations of the department.
