OPINION BY MR. JUSTICE MANDERINO, April 23, 1974:

The appellant, Wiley Jones (alias Charles Daye), was convicted of burglary and assault and battery. Post-trial motions were denied. He was sentenced to a term of not less than two nor more than four years imprisonment on the burglary conviction. Sentence was suspended on the assault and battery conviction.
