Byron Leslie Flener appeals from a judgment sentencing him to a term of eight years' confinement in the penitentiary upon a verdict which found him guilty of voluntary manslaughter in the death of his wife.

The Fleners occupied a small dwelling with five of their children, the oldest being 16 years of age. Going into the parents' bedroom at 6 a.m. one morning to awaken her mother, the oldest child found her mother lying in the bed, dead...
