ARCHIBALD, Justice.

Merle Campbell has appealed from his conviction following a jury waived trial in which he was charged, by indictment of the Knox County grand jury, with a violation of 34 M.R.S.A. § 7101 (Escape from the Maine State Prison).

The indictment charges:

"That, on or about, the Twelfth day of July, 1972, at Thomaston, County of Knox and State of Maine, Merle B. Campbell, feloniously did commit a criminal...
