The parties stipulated that all of the cases be consolidated and tried together; consequently, these suits for refund of income taxes came on for trial before the court without a jury.

FINDINGS OF FACT

1. The transaction giving rise to this case commenced about January 2, 1962. Frederick C. Peters, his three sons, and Berenice T. Peters were the owners of a tract of about 5,700 acres of vacant land situate in Broward County...
