Defendant-appellant Mullins was charged by affidavit with Count 1, sale of narcotic drugs, and Count 2, possession of narcotic drugs. Trial was had to a jury, with the verdict being not guilty as to Count 1 and guilty as charged under Count 2. Mullins was sentenced pursuant to statute. Mullins timely filed his motion to correct errors which was by the court overruled.
