This litigation commenced with a "Petition For A Writ of Mandamus" to compel defendant to sell and transfer to plaintiff shares of its stock pursuant to a stock option plan. Among various exceptions filed by defendant one of unauthorized use of summary proceedings was maintained with plaintiff given the right to amend his pleadings.
