Petitioner-appellant, Juan Ortega filed a petition for habeas corpus seeking to regain custody of his two children who were being held in violation of their divorce decree by his former wife, Jane Ortega.

After a hearing on the petition the court found conditions had changed since the original divorce decree and that the best interests of the children required custody be awarded to the mother.
