Mr. Justice McEWAN delivered the opinion of the court.

The defendant was convicted of possessing amphetamines, a controlled substance.1 Judgment was entered and the defendant was sentenced to imprisonment in the Laramie County Jail for a period of not less than five months and fined the sum of $500.00, from which judgment and sentence the defendant has appealed.
