This is an appeal from a summary judgment rendered in a concursus proceeding.

John R. Stark and Mrs. Ruth Goebel Mackey were equal owners in indivision of immovable property in the City of New Orleans. Under an exclusive agreement, Mrs. Mackey, as half owner, employed Drackett & Drackett, realtors, to sell the property.
