CUNNINGHAM v. STATE

No. 73-929.

293 So.2d 377 (1974)

Freddie Albert CUNNINGHAM, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fourth District.

April 19, 1974.

Attorney(s) appearing for the Case

Joseph A. Varon, Varon, Stahl & Kay, Hollywood, for appellant.

Robert L. Shevin, Atty. Gen., Tallahassee, and C. Marie Bernard, Asst. Atty. Gen., West Palm Beach, for appellee.

PER CURIAM.

We affirm appellant's bribery conviction upon authority of Zalla v. State, 61 So.2d 649 (Fla. 1952) and Glasgow v. State, 292 So.2d 370 (4th D.C.A. Fla. 1974). Clearly the police officer here involved had the ability and the official capacity within his line of duty to warn of impending gambling raids, all to the appellant's advantage.
