Appellant (plaintiff below), Thomas E. Powell, appeals from the order of the Circuit Court of Houston County which granted summary judgment in favor of the appellee (defendant below), Republic National Life Insurance Company, but which did not grant summary judgment in favor of Republic's co-defendant, Max K. Thompson. We dismiss the appeal for lack of jurisdiction of the subject matter.
