TURNAGE, Judge.

In this action plaintiffs' sought to recover damages from the City of Kansas City and a private developer resulting from the invasion of plaintiffs' basement by surface waters.

The trial court entered judgment for the developer, but submitted the case to the jury upon the issue of both actual and punitive damages against the City. The jury returned a verdict against the City for actual damages in the amount of $16,000.00 and punitive damages...
