Plaintiff, on his own behalf and as administrator of the estate of his minor son, filed this suit to compel the defendant to issue a birth certificate designating the child as a member of the Caucasian race. Plaintiff and his wife, both Caucasians, had adopted the child and the state health department had refused to issue a new birth certificate under the adoption law because the department was of the opinion the records of the Bureau of Vital Statistics...
