This case arises under the Massachusetts Workmen's Compensation Act. It is before this court on an appeal by American Motorists Insurance Company (American) from a Superior Court decree which awarded total incapacity and dependency compensation (to be paid by American) and dismissed a claim for such compensation against Employers' Liability Assurance Corporation, Ltd. (Employers' Liability).
