This is an appeal from an order of the District Court dismissing for lack of subject matter jurisdiction appellant's damage action based on the theory of abuse of process.

Appellee LiRocchi obtained a money judgment against appellant in the United States District Court for the Central District of California. It is averred that execution of that judgment was stayed after appellant filed a motion for a new trial, but that, nevertheless...
