OSBORN, Justice.

This is an appeal from an order of dismissal in a personal injury suit arising out of a vehicle collision. The Appellant was a passenger in a pickup truck being driven by Welton Terry Anderson when that vehicle collided with another vehicle at an intersection in El Paso, Texas, on July 13, 1968. On September 11, 1968, Appellant filed suit against Welton Terry Anderson in District Court. Mr. Anderson died on December 3, 1968, and...
