FAULKNER, Justice.

Jefferson County appeals from a declaratory decree determining the right to a tract of land. The County and the McClintons claimed ownership.

On July 15, 1952, Recie A. McClinton and Ruby McClinton conveyed to Jefferson County, Alabama, by warranty deed, a parcel of land described as follows:

"Beginning at the N.E. corner of the S.W. ¼ of the S.E. ¼ of Sec. 13, Tp. 19 S., R....
