The defendant, Cary Shafsky, was convicted by a jury of assault while armed with a dangerous or deadly weapon in violation of § 6-70, subd. B, W.S. 1957, 1973 Cum.Supp. He was sentenced to a term in the penitentiary and has appealed his conviction.
