TYSON, Judge.

The appellant, Charles William Cannon, was indicted by the Grand Jury of Jefferson County for the first degree murder of Jack Warren, Jr., by shooting him with a pistol. The Jury found the appellant guilty of murder in the second degree and fixed punishment at twenty-three years imprisonment. The trial court entered judgment in accordance with this verdict and subsequently denied appellant's motion for new trial following a hearing.
