The defendants moved for an order striking the Erie County jury pool upon the grounds that the Erie County jury selection system "illegally and unconstitutionally discriminates against black persons, women, young and poor persons" and "that the selection was not in compliance with the New York State statutes and the Rules and Regulations of the Appellate Division, Supreme Court, Fourth Department."
