Plaintiff instituted suit against defendant to recover $52,500 for alleged breach of a certain contract wherein defendant agreed to construct a warehouse by July 16, 1965, and thereafter lease the same to plaintiff. Defendant counterclaimed for a forfeiture of the contract (lease) and restitution of the premises.
