BOGUE, District Judge.

The plaintiff has filed this declaratory judgment action pursuant to 28 U.S. C. §§ 2201, 2202, seeking to have this Court adjudicate the constitutionality of two sections of the South Dakota Compiled Laws. Those sections are S.D. Comp.Laws Ann. § 21-18-10 and S.D. Comp.Laws Ann. § 21-18-12. The plaintiff has filed a Motion for Summary Judgment, briefs have been prepared and filed by each party...
