In this matter we have before us a petition for instructions by a testamentary trustee. The petition recites that the trustee was appointed on November 2, 1971 (the trustee designated in decedent's will having renounced and requested the appointment of a substitute trustee), and that the trustee received $67,283.53 from the estate of testator under Item Third of his will to fund the trust provided in his will.
