In March, 1970, the defendant was tried before a judge of the Superior Court (the trial judge) and a jury on indictments charging assault with intent to murder, assault by means of a dangerous weapon and unlawful carrying of a firearm. He absconded before the completion of the trial and was defaulted. The trial continued without him, and the jury returned verdicts of guilty on all three indictments.
