This is a civil action for assault and battery and false imprisonment in which a justice of the Superior Court entered a default judgment against the defendant in the amount of $50. In an action brought by the defendant pursuant to G.L. 1956 (1969 Reenactment) § 9-21-4,1 this court vacated the default judgment, and the case was remanded to the Superior Court for trial on the merits.
