GIVAN, Justice.

The appellee has filed a petition to transfer from the Court of Appeals. The Court of Appeals, First District, reversed the trial court and ordered a new trial, holding the trial court erred in giving an instruction on impairment of earning capacity. See Cooper v. High (1973), Ind. App., 303 N.E.2d 829, 39 Ind.Dec. 708.

We grant transfer in this case and sustain the trial court.
