The facts in this case are similar to those reported in the case of Zimmerman v. Hogg & Allen, N.C.App., 207 S.E.2d 267, opinion in which is filed this day. For the reasons as set forth in Zimmerman v. Hogg & Allen, the judgment of the trial court is affirmed.
