GILLESPIE, Chief Justice:

Tony Hammons was convicted of robbery by the Circuit Court of Jackson County and sentenced to serve nine years in the penitentiary.

The defendant, together with Thomas Lang, Jimmy Paulk and Horace Eugene Vick, was riding around and drinking intoxicating beverages. They saw three hitchhikers, Earl Wade Lawless, James Howard, and another young man from the Air Force. The defendant stopped his car and picked up the three hitchhikers...
