The defendant has appealed from a conviction for first degree murder. He was sentenced to life imprisonment.

On the evening of June 24, 1973, a deputy sheriff and another individual were investigating a report of poaching in the area. While doing this, they observed a vehicle approaching and then turning around and quickly departing.
