OPINION

ROBERTS, Chief Justice.

The defendant here, Phillip D. Carufel was indicted on October 8, 1968, for possession of cannabis in violation of G.L. 1956, § 21-28-31, as amended by P.L. 1962, ch. 110, sec. 1. A pretrial motion to suppress was denied. At a trial before a justice of the Superior Court sitting with a jury in April of 1969, the state introduced the cannabis into evidence over the defendant's objection. He was subsequently found guilty...
