UHLENHOPP, Justice.

This appeal involves rulings made in the prosecution of defendant Phillip Manning on a charge of depositing an incendiary device.

Section 697.3 of the Code provides in pertinent part:

If any person, with intent to destroy or injure any building . . . deposits. . . in, under, or about such building. . . any . . . incendiary device . . . by the combustion. . . of which any such structure...
