Facts.

Plaintiff in error, Stuart A. Holmes, hereinafter referred to as the defendant, was charged with armed robbery (sec. 943.32 (1) (b) and (2), Stats.) and attempted murder (secs. 940.01 and 939.32). Following preliminary hearings and bindovers for trial, the state moved to consolidate the charges for trial, and the motion was granted. Following jury trial, defendant was found guilty on both charges on November 11, 1970, and sentenced to twenty years...
