The petitioner, Barry Wintersmith, was convicted of voluntary manslaughter and was sentenced to a term of 8 to 15 years in the Illinois State Penitentiary after a trial in the Circuit Court of Cook County. The conviction was affirmed in People v. Wintersmith (1972), 9 Ill.App.3d 327,
