The People appeal, pursuant to CPL 450.20 (subd. 1) and 450.60 (subd. 3) the order of the City Court of Binghamton, New York, dismissing the information charging the defendant with operating a motor vehicle while he had .12 of one per centum or more by weight of alcohol in his blood in violation of subdivision 2 of section 1192 of the Vehicle and Traffic Law.
