WALDEN, Judge.
The Okeechobee County Grand Jury inquired into the death of Charles McArthur. An indictment was returned charging the decedent's wife, Nadean McArthur, with first degree murder. The defendant, Mrs. McArthur, duly filed a motion to dismiss the indictment. The trial court granted same on the ground that the state had failed to have a court reporter or stenographer present to record the testimony presented to the Grand Jury. The state appeals.
