KEYSER, Justice.

This is a civil action brought on October 21, 1969, against three minors to recover damages resulting from the unlawful taking and negligent operation of plaintiff's automobile. The parents of said minors were also made defendants to the action.

Just before the case was to be heard by the court on May 19, 1972, settlement was negotiated by two of the minors and their parents. This left Elwood Howe and his parents as the remaining defendants...
