OPINION

BEACH, J.

After a court trial, defendant was convicted of assault with a deadly weapon on a police officer engaged in the performance of his duties (Pen. Code, § 245, subd. (b)); the court also found that he had used a firearm, to wit, a .22 caliber rifle, within the meaning of Penal Code section 12022.5.1
