DORIS, Justice.

On May 24, 1970, the defendant was clocked for speeding on Post Road in Warwick by Officer Kenneth R. David of the Warwick Police Department. On June 2, 1970, Captain John H. Hallbauer of the Warwick Police Department complained to the Third Judicial District Court of the State of Rhode Island that the defendant violated G.L. 1956 (1968 Reenactment) § 31-14-1 in that he

"* * * did operate a motor vehicle on Post Road...
