This cause is before us on petition for writ of habeas corpus, or, in the alternative, a constitutional writ. We treated the matter as a petition for writ of mandamus. We issued the alternative writ to the Honorable Ernest E. Mason, Circuit Judge of the First Judicial Circuit, in and for Escambia County, the trial court judge, and he has promptly filed his return thereto.
