This is an election contest. Appellant ran as the incumbent for the office of Sheriff of Columbia County in the 1972 primary elections. Appellee Bailey ran for the same office. When the precinct votes were counted, Bailey was ahead by a small margin of 36 votes. But, after the absentee votes were counted, appellant had edged ahead to a slight victory by 50 votes.
