Defendant appeals from a conviction, upon his plea of guilty, of a class D felony of criminal possession of a controlled substance in the sixth degree, for which he could have been sentenced to a maximum term of seven years. He was sentenced to an indeterminate term with a maximum of four years and has begun serving that sentence in Attica Correctional Facility.
