Appellants, Algie Ray Grimes, Earnest L.Edmondson, Tommy Jordan Marlow, and Patricia Ann Fairchild Marlow, hereinafter referred to as defendants, were charged with the offense of Possession of a Controlled Substance, Marijuana, with the Intent to Distribute, in the District Court, Custer County, Case No. CRF-73-12.
