The plaintiff served as a yeoman in the United States Navy prior to December 21, 1972. He was tried by a special court-martial on December 21, 1972, and January 18 and 25, 1973, after being charged pursuant to 10 U.S.C. § 886 (1970) with four specifications of unauthorized absence from his unit.
