In the District Court, Lincoln County, Case CRF-73-63, appellant Herbert McGee, hereinafter referred to as defendant, was charged with the offense of Shooting With Intent to Kill, tried in the District Court, and convicted for the lesser included offense of Discharging a Firearm in a Public Place.
