Plaintiff brought action for wrongful death, MCLA 600.2922; MSA 27A.2922, arising when plaintiff's six-year-old son was struck by a vehicle driven by Frank Carpenter. Originally a party to this suit, Carpenter died before trial, and his wife, who as administratrix of his estate had been substituted as a party, successfully obtained an accelerated judgment on the grounds that she was served with process when she was no longer administratrix of the estate...
